Kentucky remodeling license requirements.

Kentucky has no statewide license or registration for remodeling or home improvement contractors. The Department of Housing, Buildings and Construction licenses only specific trades, including HVAC, electrical and plumbing, so a remodeler needs licensed trade partners rather than a contractor license. Permits come from the local building department, and in-home sales carry a three day cancellation right.

Who issues a remodeling license in Kentucky, and who does not

Kentucky issues no statewide license and no statewide registration for residential remodeling or home improvement contracting. There is no state home improvement number to print on a Louisville kitchen bid or a Lexington bathroom gut. The Department of Housing, Buildings and Construction is the state agency a remodeler deals with, and the department describes its own duties narrowly. It enforces statewide standards for building construction, and it licenses or certifies plumbers, electricians, boiler contractors, sprinkler and fire alarm contractors, and building inspectors. Remodelers do not appear on that list. The department also runs HVAC and manufactured housing licensing through separate divisions, both of which show up as selectable divisions in its public licensee search. So compliance in Kentucky has three layers, and a remodeling company has to clear all three. The first layer is the Uniform State Building Code, which KRS 198B.050 directs the department to adopt as a mandatory code covering the construction of all buildings in the state. The second layer is the local building department, which issues permits and runs inspections. The third layer is the trade license, which attaches to the person performing mechanical, electrical or plumbing work rather than to the remodeling business. A remodeling company in Kentucky can operate legally holding no occupational license of its own, provided every regulated scope inside the job is performed by someone who holds the correct state trade license and provided the permits are pulled. That is a different problem than a licensing state hands you. It moves the risk into your subcontractor file, your permit paperwork and your advertising copy. Those three places are where Kentucky enforcement actually lands.

The state code, the local permit, and the single family exception

KRS 198B.050 makes the Uniform State Building Code mandatory and comprehensive. It covers general construction, structural quality, mechanical systems including heating, cooling and ventilation, electrical systems, and life safety from fire and explosion. It absorbs the Kentucky State Plumbing Code and the national electrical code. Plan review for conformance may be done only by the department or by a local government the chapter delegates it to. KRS 198B.060 then puts enforcement on local government. Each local government must employ a building official or inspector, or contract for inspection and code enforcement services, to enforce the code inside its boundaries. The sentence that matters most to a remodeler sits in the same subsection: permits, inspections and certificates of occupancy are not mandatory for single family residences unless a local government passes an ordinance requiring inspections of single family residences. That one clause explains why permit practice for house work varies so much across Kentucky counties. Two jobs with identical scopes can carry different paperwork depending on which jurisdiction they sit in. Local governments are responsible for issuing and revoking building permits, licenses and certificates covering activities in their area of responsibility, and for inspecting buildings under the code. Each local government issuing a building or demolition permit, or an initial certificate of occupancy on a new structure, has to send a copy to the commissioner so the state can keep an accurate housing inventory. The practical rule for a remodeling business is simple. Never assume. Call the building department for the specific city or county before you quote the job, and write the permit responsibility into the contract.

The trade licenses a remodeler cannot work around

The absence of a remodeling license does not make a Kentucky remodel license free. Three trades inside a typical renovation are licensed by the state, and each one has its own prohibition. For heating, ventilation and air conditioning, KRS 198B.656 says a person shall not practice HVAC contracting unless that person has met the requirements of the licensing sections, and shall not claim to be or advertise as a master HVAC contractor, journeyman HVAC mechanic or apprentice HVAC mechanic without the matching license or certificate. The holder of a valid master HVAC contractor license is entitled to obtain the necessary permits for HVAC work and is primarily responsible for the HVAC work performed. For electrical, KRS 227A.020 bars an unlicensed person from engaging in any activities or performing any duties usually performed by an electrical contractor, electrician or master electrician, unless that unlicensed person is under the direct supervision of a licensed electrician or master electrician who is present on the site. For plumbing, KRS 318.030 says no person shall engage in plumbing or work at the trade of plumbing unless they hold a valid active master plumber license or a journeyman plumber license issued by the department. Read together, those three statutes define the shape of a compliant Kentucky remodeling company. You either employ licensed tradespeople or you subcontract to licensed firms, and you keep current copies of their licenses and insurance on file. The homeowner signs with you, but the state looks through your company name to the person who actually touched the ductwork, the panel and the drain line.

Master HVAC contractor license: experience, exam and insurance

If your remodeling company wants to hold HVAC capability in house, someone has to carry the master HVAC contractor license. KRS 198B.658 sets the qualifications. The applicant must be at least eighteen years of age and be a United States citizen or a resident alien authorized to work in the United States. The experience requirement can be met three ways: two years regularly and principally employed in HVAC trades as a journeyman HVAC mechanic under the direction and supervision of a master HVAC contractor; two years regularly and principally engaged in the practice of HVAC contracting as a master HVAC contractor or equivalent, in Kentucky or another jurisdiction, shown by verifiable documentation; or two years regularly and principally licensed and employed as a mechanical engineer in Kentucky or another jurisdiction, again with verifiable documentation. The applicant must pass an examination prescribed by the department to determine competency to practice HVAC contracting, and must pay the fee set by administrative regulation. The journeyman HVAC mechanic license follows a parallel two year experience rule. The department's own master HVAC contractor license application adds the insurance condition. It instructs the applicant to attach a certificate of insurance showing general liability of not less than $500,000 and property damage of not less than $300,000, with the Department of Housing, Buildings and Construction listed as certificate holder, and it states that the license cannot be issued without a certificate on file. KRS 198B.676 is the fee authority. It lists the fee categories the department may set by regulation, including initial application, examination, license renewal, certificate renewal, duplicate, inactive status, restoration, reactivation and change of information, and caps them at the cost of running the licensing program.

Electrical contractor and master electrician requirements

Electrical work on a Kentucky remodel runs through KRS Chapter 227A. KRS 227A.060 sets three licenses and three price ceilings. For an electrical contractor license, the applicant pays an application fee not to exceed $200 plus the examination fee, passes all portions of the required examination, and submits proof of compliance with workers compensation and unemployment insurance law together with a general liability policy of not less than $1,000,000. For a master electrician license, the application fee cannot exceed $100, and the applicant must document 16,000 hours of verifiable experience in the electrical trade since the sixteenth birthday. Two substitutions shorten that. An acceptable training course in electrical work, or two years teaching electrical technology or a related field at an accredited college or university, each substitute for 4,000 hours. An associate degree or diploma program in electrical technology or a related field at a Kentucky Community and Technical College System school or an accredited college or university substitutes for 6,000 hours. For an electrician license the application fee cannot exceed $50 plus the examination fee. KRS 227A.020 also settles the city question that trips up contractors working across county lines. The chapter supersedes all ordinances or regulations of any city, county, urban county, charter county or consolidated local government that regulate electricians, master electricians and electrical contractors. Zoning requirements and occupational payroll taxes are carved out and still apply. An authorized local licensing program that existed on June 24, 2003 may contract with the department to act as its agent for issuing and renewing these licenses.

Plumbing license and the insurance floor that comes with it

Plumbing carries the most specific money requirement in the Kentucky set. KRS 318.030 bars anyone from engaging in plumbing or working at the trade of plumbing without a valid and effective active master plumber license or a journeyman plumber license issued by the department. The same statute then adds an insurance mandate that reaches the firm, not only the individual. No person, firm or corporation shall engage in plumbing unless it maintains general liability insurance in an amount not less than $250,000 and submits proof of compliance with Kentucky workers compensation and unemployment insurance law. Proof of that insurance has to reach the department before the active master plumber license is issued or renewed. No license is valid without the insurance, and insurance carriers must notify the department when a covered licensee's policy is cancelled. The requirement does not apply to an employee of a person, firm or corporation engaged in plumbing, so the obligation sits with the licensed business. KRS 318.054 handles the clock. An initial master or journeyman plumber license expires on the last day of the licensee's birth month in the following year, and renewed licenses expire on the last day of the birth month each year after issuance. The department must mail a renewal notice to the licensee's last known address no later than thirty days before expiration, and renewal requires evidence of completing continuing education. A late renewal needs the renewal fee plus a revival fee of $5 for a master plumber and $3 for a journeyman. If renewal and revival fees are not paid within 180 days after expiration, the license is cancelled by operation of law, and reinstatement then costs all delinquent renewal fees plus a revival fee of $10 for a master or $6 for a journeyman.

Advertising, vehicle lettering, and the titles you may claim

This is where Kentucky regulates the marketing side of remodeling, and the rule is unusually concrete. KRS 198B.670 says no person shall advertise as or claim to be a master HVAC contractor unless licensed by the department, and then adds a display mandate: the license number shall appear in all advertising and on all vehicles used by the licensee for HVAC contracting work. All advertising covers the website, the truck wrap, the yard sign and the print piece, so a remodeling company that holds or employs a master HVAC license has a number to carry into every channel. KRS 198B.656 reinforces the title rule. A person may not claim to be, advertise as, or assume or use any title, designation or abbreviation likely to create the impression of master HVAC contractor, journeyman HVAC mechanic or apprentice HVAC mechanic licensure without holding it. Plumbing has a shorter version. KRS 318.100 says no person shall advertise as or claim to be a licensed master or licensed journeyman plumber in Kentucky without holding that license from the department. Electrical is stricter about implied claims. KRS 227A.020 bars an unlicensed person from representing himself or herself to the public as an electrical contractor, master electrician or electrician, and from using any terms, titles or abbreviations which express or imply that licensure. For a remodeling company the discipline is straightforward. Describe what you do in plain language, name the licensed trade partner where a licensed trade is involved, and never let a headline or a vehicle door imply a trade license the company does not hold. Separately, KRS 367.170 makes unfair, false, misleading or deceptive acts or practices in trade or commerce unlawful, and unfair is construed to mean unconscionable.

Penalties for unlicensed work and false claims

Kentucky backs each trade statute with its own penalty, and they are not symmetrical. For HVAC, KRS 198B.686 makes it a Class A misdemeanor for a person who requires licensure or certification, and does not hold it, to practice HVAC contracting services, and each violation is a separate offense. The second subsection reaches advertising directly. Any person who advertises or otherwise holds himself out as a licensed master or journeyman HVAC contractor without being so licensed is guilty of a Class A misdemeanor, again with each violation treated separately. That means a single false claim repeated across a website, a truck and a flyer is not one problem. For electrical, KRS 227A.130 states that a person who violates or aids in the violation of KRS 227A.020 is guilty of a misdemeanor and on conviction shall be fined not less than $500 and not more than $5,000, or sentenced to jail for not less than ten and not more than 180 days, or both. The phrase aids in the violation matters to a remodeler who hires help off the books, because it reaches the general who puts an unlicensed hand on a panel. KRS 198B.060 adds a permit level penalty. No permit for building, construction, reconstruction, renovation, demolition or maintenance may be issued by any building department or political subdivision unless the applicant assures by affidavit that all contractors and subcontractors employed on the permitted activity comply with Kentucky workers compensation and unemployment insurance law. A person who fails to comply with that assurance shall be fined up to $4,000, or an amount equal to the sum of all uninsured and unsatisfied claims, whichever is greater, and the county attorney enforces it.

The three day right to cancel on in-home sales

Kentucky has no home improvement contractor statute, but it does have a home solicitation sales statute, and residential remodeling sold at the kitchen table falls inside it. KRS 367.410 defines a home solicitation sale as a sale of goods or services, including consumer loans, in which the seller or a person acting for the seller engages in a personal solicitation of the sale at a residence of the buyer, and the buyer's agreement or offer to purchase is given there. The definition excludes a sale made pursuant to prior negotiations between the parties, a sale by telephone initiated by the buyer, and a sale at a business establishment at a fixed location where goods or services are offered or exhibited for sale. KRS 367.420 then gives the buyer the right to cancel a home solicitation sale until midnight of the third business day after the day the buyer signs a complying agreement or offer to purchase. Cancellation happens when the buyer gives written notice to the seller at the address stated in the agreement, and notice mailed is given when deposited in a properly addressed, postage prepaid mailbox. The notice needs no particular form. Any written expression of the buyer's intention not to be bound is enough. There is an emergency carve out. The buyer may not cancel if the buyer asked the seller to provide goods or services without delay because of an emergency, the seller in good faith made a substantial beginning of performance before notice, and in the case of goods the goods cannot be returned in substantially as good condition as received. Where a security interest is taken in the buyer's principal dwelling, the cancellation window runs to midnight of the tenth business day.

The cancellation notice your contract has to carry

KRS 367.430 dictates contract mechanics for a Kentucky remodeler who sells in the home, and it is prescriptive down to the caption. Unless the buyer asks the seller to provide goods or services in an emergency, the seller must present to the buyer and obtain the buyer's signature on a written agreement or offer to purchase. That document must designate as the date of the transaction the date the buyer actually signs, and it must contain a statement of the buyer's rights. The statement has to appear under the conspicuous caption BUYER'S RIGHT TO CANCEL. It then has to read as the statute writes it: if this agreement was solicited to your residence and you do not want the goods or services, you may cancel this agreement by mailing a notice to the seller, the notice must say that you do not want the goods or services and must be mailed before midnight of the third business day after you sign this agreement, and the notice must be mailed to the address the form provides. The enforcement mechanism is the part sellers underestimate. Until the seller has complied with that section, the buyer may cancel the home solicitation by notifying the seller in any manner and by any means of the intention to cancel. A missing or non conforming notice does not merely risk a fine. It leaves the cancellation right open with no clock and no format requirement. KRS 367.460 closes the last exit: any waiver by the buyer of the rights provided in KRS 367.410 to 367.450 is null and void, and will not relieve the seller of any obligation those sections place on the seller.

Renewal and continuing education for the licensed trades

Each licensed trade a remodeler relies on runs on its own renewal cycle, and a lapsed subcontractor license can stall your permit. For electrical, KRS 227A.100 sets a biennial renewal due on or before the last day of the licensee's birth month in the second year, with the renewal fee doubled for the two year term. A sixty day grace period follows expiration, during which the licensee may continue to practice and may renew by paying the renewal fee plus a late renewal fee set by regulation. A license not renewed by the end of that grace period terminates, and the former licensee is no longer eligible to practice in the Commonwealth. Reinstatement after termination requires the renewal fee plus a reinstatement fee, and no examination is required if the reinstatement application is made within three years of termination. Renewal or reinstatement also requires evidence of completing at least six hours of continuing education per year, provided by one of the named industry bodies, the Kentucky Department of Housing, Buildings and Construction, or another provider the department approves. A suspended license still expires and must be renewed, but renewal alone does not restore the right to practice. A revoked license may not be renewed. For plumbing, KRS 318.054 runs an annual cycle tied to the licensee's birth month, with renewal conditioned on evidence of completing the continuing education the department establishes by regulation. For HVAC, KRS 198B.676 authorizes license renewal, certificate renewal, inactive status, restoration and reactivation fees set by administrative regulation and capped at program cost. Verify current amounts with the department before you budget.

Reciprocity and bringing out of state trade help into Kentucky

A remodeler expanding into Kentucky, or pulling a crew across the Ohio River for one job, has two statutory doors and one timing trap. For HVAC, KRS 198B.666 allows a person licensed in another state to be issued an equivalent Kentucky license, on terms and conditions the department determines, if that state's licensing, educational and experience requirements are substantially equal to or greater than Kentucky's and that state grants equal licensing privileges to Kentucky licensees. For electrical, KRS 227A.070 provides licensure by endorsement. On application and payment of all applicable fees, the department shall license by endorsement an applicant registered, licensed or certified in another state if that state's requirements are substantially equal to Kentucky's and the applicant is in good standing, and only if the issuing state extends similar reciprocity to Kentucky licensees. Both doors turn on the other state's rules, so the answer differs by state and the department decides. The timing trap sits in KRS 227A.030. Nothing in the electrical chapter precludes using unlicensed nonresident electricians in temporary, emergency or industrial shutdown situations, but those electricians shall apply for an electrician or master electrician license after they are employed and engaged in electrical work in Kentucky for ten days. No unlicensed nonresident electrician may be employed or engaged in electrical work in Kentucky for more than thirty days total in any calendar year without applying, and the license must be obtained within sixty days of securing employment. The same statute also confirms that nothing in the chapter prohibits a homeowner or farmer from installing or repairing electrical wiring on their own real property, which is a common source of confusion on remodels.

Louisville Metro and Lexington-Fayette: the city layer that does exist

The state does not license remodelers, but Kentucky's two largest metros add their own requirements, and both attach to the permit rather than to the trade. Louisville Metro runs contractor licensing through its Construction Review function, and it publishes license categories by type rather than one general contractor license. The building categories distinguish a contractor seeking multiple permits within Louisville Jefferson County from a contractor seeking a single building permit, and separate categories cover HVAC, manufactured fireplace, range hood, mechanical refrigeration, fire detection, fire suppression, moving, sign and wrecking work. The HVAC category is conditioned on holding the Commonwealth of Kentucky master HVAC contractor license, which is a direct hook from the state statute into the local license. Wrecking categories carry surety bond and insurance conditions and a written examination. Confirm the current fee amounts, bond figures and license terms with Construction Review before you apply, because those change. Lexington-Fayette is simpler to state and broader in reach. Building Inspection enforces the Kentucky Building Code, and the division says a contractors registration ordinance requires all contractors to register with Building Inspection, that it has registered more than 1,600 contractors to work in Lexington-Fayette County under that ordinance, and that unregistered contractors cannot obtain building permits. The division also publishes a Contractor Registration Verification Form and permit guides that include Residential Remodel and Residential Addition, alongside separate pages for electrical permits, licensing and inspections and for plumbing permits. The lesson for a remodeling business selling in both markets is that your license file is a city by city file, not a state file.

Workers compensation, the permit affidavit, and business basics

Kentucky ties insurance compliance to the permit counter, which makes it a remodeling problem rather than a back office problem. KRS 342.630 makes any person other than one engaged solely in agriculture a mandatory employer under the workers compensation chapter if it has one or more employees subject to that chapter in the state. One employee is the threshold. KRS 198B.060 then puts teeth on it at the moment you ask for paper. No permit for building, construction, reconstruction, renovation, demolition or maintenance, or for any activity related to those, may be issued by any building department or any political subdivision of Kentucky unless the applicant assures by affidavit that all contractors and subcontractors employed, or that will be employed, on the permitted activity comply with Kentucky workers compensation requirements under KRS Chapter 342 and unemployment insurance requirements under KRS Chapter 341. That affidavit is signed by the permit applicant, which on most remodels is you, and it reaches down your subcontractor chain. The penalty for failing to comply with the assurance is a fine of up to $4,000 or an amount equal to the sum of all uninsured and unsatisfied workers compensation claims and unemployment claims for which no wages were reported, whichever is greater, enforced by the county attorney for the county where the violation occurred. Applying for a building permit also carries consent. By the act of applying, the applicant is deemed to have consented to inspection of the building during construction and on completion, so the local government or the department can confirm code compliance. Keep current certificates for every sub on file and refresh them before each permit application.

How a customer verifies you, and the recovery fund question

Kentucky gives homeowners a real verification tool, which cuts both ways for a remodeler. The Department of Housing, Buildings and Construction publishes a licensee search covering building inspector, electrical, electrical inspection, manufactured housing, HVAC, plumbing and fire licensees. The search page lets anyone query by professional trade name, license type, licensee name, license number or status, and it offers division filters that include the Division of Electrical, the Division of HVAC, the Division of Plumbing, the Division of Building Code Enforcement, the Division of Fire Prevention and the Division of Manufactured Home and RV and Certified Installer. License number, issue date and expiration date appear once a license is active. Point prospects at it. A homeowner who can confirm your HVAC or plumbing partner in thirty seconds is a homeowner who stops shopping on price alone. Lexington-Fayette adds a local check through its Contractor Registration Verification Form. Because Kentucky licenses no remodeling contractor, there is no state remodeling license for a customer to look up and no state remodeling complaint register. Consumer complaints about deceptive remodeling practices run through the Office of the Attorney General, and KRS 367.170 declares unfair, false, misleading or deceptive acts or practices in trade or commerce unlawful, with unfair construed to mean unconscionable. We located no primary Kentucky source establishing a state recovery fund, guaranty fund or restitution fund for home improvement or remodeling customers, so treat your own insurance, your written contract and your warranty language as the only backstop a Kentucky homeowner has.

Kentucky remodeling licensing questions

Do I need a state contractor license to remodel homes in Kentucky?

No. Kentucky issues no statewide remodeling or home improvement contractor license. The Department of Housing, Buildings and Construction licenses specific trades, including plumbers, electricians, boiler contractors and sprinkler and fire alarm contractors, plus HVAC and manufactured housing through its divisions. Your obligations are permits, licensed trade partners and city registration where a city requires it.

Who licenses the HVAC work on a Kentucky remodel?

The Department of Housing, Buildings and Construction. KRS 198B.656 says a person shall not practice HVAC contracting without meeting the licensing requirements, and the master HVAC contractor is entitled to obtain the necessary permits and is primarily responsible for the HVAC work performed. Practicing without the license is a Class A misdemeanor under KRS 198B.686.

Does my advertising have to show a license number in Kentucky?

If you hold a master HVAC contractor license, yes. KRS 198B.670 requires the license number to appear in all advertising and on all vehicles used by the licensee for HVAC contracting work. The same statute bars advertising as a master HVAC contractor without the license. Plumbing and electrical statutes restrict titles rather than requiring number display.

Can an unlicensed worker touch electrical on my remodel?

Only under direct supervision. KRS 227A.020 bars an unlicensed person from performing duties usually performed by an electrical contractor, electrician or master electrician unless that person is under the direct supervision of a licensed electrician or master electrician who is present on the site. Violating or aiding a violation carries fines of $500 to $5,000 under KRS 227A.130.

How long does a homeowner have to cancel a contract I sold in their house?

Until midnight of the third business day after the day they sign a complying agreement, under KRS 367.420. Cancellation happens when they give written notice to the address stated in the agreement. Mailed notice counts when deposited postage prepaid. If a security interest is taken in the principal dwelling, the window runs to the tenth business day.

What exact wording must a Kentucky in-home remodeling contract carry?

KRS 367.430 requires a written agreement the buyer signs, dated the day they actually sign, containing a rights statement under the conspicuous caption BUYER'S RIGHT TO CANCEL. The statute prescribes the text, including the instruction to mail notice before midnight of the third business day. Until you comply, the buyer may cancel in any manner and by any means.

Can a homeowner waive the cancellation right to let me start sooner?

No. KRS 367.460 makes any waiver by the buyer of the rights in KRS 367.410 to 367.450 null and void, and it does not relieve the seller of any obligation those sections impose. There is a narrow emergency exception in KRS 367.420 when the buyer requests work without delay and you make a substantial beginning in good faith.

Is a building permit always required for a single family remodel in Kentucky?

Not automatically. KRS 198B.060 says permits, inspections and certificates of occupancy are not mandatory for single family residences unless a local government passes an ordinance requiring inspections of single family residences. Local governments issue and revoke permits in their own area of responsibility, so confirm the rule with the specific city or county building department first.

Does Louisville Metro require its own contractor license?

Louisville Metro publishes contractor license categories by type through Construction Review, separating a contractor seeking multiple permits in Louisville Jefferson County from one seeking a single building permit, with separate HVAC, fireplace, range hood, refrigeration, fire detection, fire suppression, moving, sign and wrecking categories. The HVAC category requires the state master HVAC contractor license. Confirm current fees directly.

Do I have to register with Lexington before pulling a permit there?

Yes. Lexington-Fayette Building Inspection states that a contractors registration ordinance requires all contractors to register with Building Inspection, and that unregistered contractors cannot obtain building permits. The division reports registering more than 1,600 contractors under that ordinance. It also publishes a Contractor Registration Verification Form and permit guides covering Residential Remodel and Residential Addition.

How much liability insurance does a Kentucky plumbing firm have to carry?

KRS 318.030 requires any person, firm or corporation engaging in plumbing to maintain general liability insurance of not less than $250,000 and to submit proof of workers compensation and unemployment insurance compliance. Proof must reach the department before an active master plumber license is issued or renewed, and no license is valid without that insurance in force.

Where can a customer check the trade licenses behind my remodel?

The Department of Housing, Buildings and Construction runs a public licensee search covering building inspector, electrical, electrical inspection, manufactured housing, HVAC, plumbing and fire licensees. Anyone can search by trade name, license type, licensee name, license number or status, and license number, issue date and expiration date appear once a license is active.
